A US ex-cop who was jailed for possession of child sexual abuse images has been denied CBD by a judge.
Stanley Nadoraski, from the town of Colonie in Albany County, New York, pleaded guilty in 2009 after cops found him in possession of 15 still images and 12 videos depicting minors engaged in sexually explicit conduct.
The 51-year-old was jailed for 30 months and received 10 years of supervised release. Nadoraski violated conditions of his release in 2014, 2015, and last month for using cannabis.
The ex-cops’ attorney, Michael McGeown-Walker, recently informed Senior US District Judge Norman Mordue that his client would like to use CBD oil instead of cannabis to treat his post-traumatic stress disorder symptoms, reports the Times Union.
Nadoraski retired on disability after surviving a November 1999 shooting.
However, Assistant US Attorney Rick Belliss argued that many CBD oil products contain concentrations of THC higher than 0.3% – the legal limit.
The official noted drug lab testing cannot pinpoint if a positive THC result comes from CBD oil or cannabis.
Nadoraski was sentenced to three months in prison and five more years of supervised release for the cannabis violation. He will also not be allowed to use CBD.
In May Nadoraski wrote to Mordue asking for early release from his supervision.
He wrote: “During times of extreme stress and anxiety, which lasts for several days, the only two choices I can see at the moment is smoke a little marijuana or kill myself. It is that severe.
“In times without extreme stress and anxiety, there are clearly more options than those two – and I do use them during those times. I’m trying to learn and condition myself to be able to see those other options when I’m in crisis.”
